New Jersey may require presidential candidates to disclose federal tax return

New Jersey lawmakers became the first state to require presidential and vice-presidential candidates to reveal their federal income tax return before being listed on the state’s ballot, when the Legislature approved S3048 on Thursday.

The legislation, which was passed along party lines by the Democrat-controlled legislature and needs Governor Chris Christie’s signature to become law, also prohibits Electoral College electors from voting for candidates who fail to release their income tax returns.

The Senate approved the bill March 13 with 24 members voting in favor, 11 against and five not voting. On March 16, the Assembly passed the bill with 49 members voting in favor, 25 against and six not voting.

The measure was inspired by President Donald Trump’s refusal to release his own tax-returns. Though many believe Christie is unlikely to sign the bill, others question whether a state may impose such requirements on a federal candidate.

At least 22 other states have passed similar legislation, and others contemplate doing so.

A number of bi-partisan experts and advocacy groups have expressed concerns over potential ethical issues being faced by Trump.

In January he Citizens for Responsibility and Ethics in Washington (CREW) filed a lawsuit in federal court claiming that Trump’s continued business dealings violate the Emoluments Clause of the Constitution.

The same month the American Civil Liberties Union (ACLU) filed a request under the Freedom of Information Act for “records pertaining to financial and other ethical conflicts of interest in connection with the presidential transition ….”

Two government ethics lawyers who counseled former presidents George W. Bush and Barack Obama have also expressed concerns over Trump’s refusal to disclose his tax returns, which they argue is an impediment to ensuring that the actions of the new administration will be conflict-free.

Concerns have also been voiced over the more than 4,000 open lawsuits involving Trump and his businesses.
