Linden Council Votes To Replace City Judge

LINDEN — Mayor Richard Gerbounka won a long-awaited victory when Dan Roberts was appointed municipal court judge by the City Council.

Roberts replaces Louis M. J. DiLeo, a 58-year-old Westfield resident who had served as Linden’s judge since 2003.

Last year, a formal complaint was filed against DiLeo, accusing him of violating the judicial code of conduct by denying two defendants a public defender and by allowing a police officer to cross-examine them at their trial on burglary and theft charges. DiLeo denied any wrongdoing.

Five of the 11 members of the City Council opposed the appointment of Roberts to replace DiLeo: Richard Koziol, Peter Brown Jr., Rhashonna Cosby-Hurling, Robert J. Sadowski and Michele Yamakaitis.

In 2011, the City Council voted against replacing DiLeo by a 6-5 margin.
