Borino was originally arrested on a criminal Complaint by inspectors with the United States Postal Inspection Service. At his plea hearing, Borino admitted that he possessed and stored more than 600 images and videos containing child pornography on two computers and more than 100 CDs and DVDs in his home. The images portrayed individuals less than 18 years old engaged in sexually explicit conduct, including numerous minors under the age of 12. The images also portrayed sadistic or masochistic conduct or other depictions of violence.

According to statements made in Trenton federal court, Borino possessed at least 340 videos and 12,500 still images. Per the advisory United States Sentencing Guidelines, each video containing child pornography is considered the equivalent of 75 images – meaning Borino possessed a total of at least 38,000 criminal images of child pornography.

In addition to the prison term, Brown sentenced Borino to five years of supervised release and ordered him to pay a $5,000 fine.
