Ex-School Guard Admits Fondling Student

NEW BRUNSWICK – A former New Brunswick elementary school security guard has pleaded guilty to a charge of kissing and fondling a 13-year-old female student, Middlesex County Prosecutor Bruce J. Kaplan announced Thursday.

Elpidio Cruz, 26, pleaded guilty on Feb. 17 to a third degree count of aggravated criminal sexual contact. Cruz waived his right to a trial and pleaded guilty following negotiations with Middlesex County Assistant Prosecutor Lynn Pilone.


Under the plea agreement, Cruz, who formerly worked at Roosevelt Elementary School on Livingston Avenue in New Brunswick, faces parole supervision for life and must register as a sex offender under Megan’s Law. In addition, he will be banned from holding a public job.

Cruz is scheduled to be sentenced on June 11 by Superior Court Judge Barbara Stolte at the Middlesex County Courthouse in New Brunswick.

Cruz was arrested and charged Sept. 8, 2009, after an investigation by Detective Daniel Dominguez of the New Brunswick Police Department and Investigator Michael Daniewicz and Investigator Jeffrey Maroccia, both of the Middlesex County Prosecutor’s Office, determined that he had developed a friendship with the student when she attended Roosevelt School, and engaged in improper conduct with her at his home on a number of occasions between May 2009 and September 2009.
